1. Name

The club is called Burneside Angling Association (‘The Association’).
2. Objects

The objects of the Association are to foster the enjoyment, improvement, and
encouragement of the Act of Angling within its defined area and to encourage co-operation
with neighbouring Angling Associations.
3. Management

The Association is managed by;


-Chairman, Vice Chairman, Secretary, Treasurer (‘The Officers’)
-and a Committee of up to six members (Full Members or Honorary Life Members) (‘The Committee’)

The Officers

The Officers shall be elected at the Annual General Meeting in each year and subject to termination of office by resignation, removal, or otherwise, the Officers shall remain in office until their successors are elected at the Annual or a Special General Meeting following their election.
The Officers must be nominated for election by a proposer and a seconder, both of whom shall be Full Members or Honorary Life Members of the Association, and the Secretary shall receive the nominations at least seven days before the Annual General Meeting.
All Officers shall be honorary. The Officers shall be indemnified out of the funds of the Association for all liabilities, losses, costs, and expenses incurred in carrying out matters relating to the Association.
All Officers must retire every 3 years from the date on which they were elected as Officers.
Any retiring Officer may be re-elected as an Officer.


The Committee

The Committee shall be elected at the Annual General Meeting in each year and, subject to termination of office by resignation, removal, or otherwise, the Committee shall remain in office until their successors are elected at the Annual General Meeting or a Special General Meeting following their election.
The Committee shall be appointed by nominations by a proposer and a seconder, both of whom shall be Full Members or Honorary Life Members of the Association. The Secretary must receive the nominations at least seven days before the Annual General Meeting.
All Committee members must retire every 3 years from the date on which they were elected as Committee members.
(4) Any retiring Committee member may be re-elected as a Committee member.
 


4. Application for membership

4.1 Every candidate for membership must be proposed by one Full Member or Honorary Life Member and seconded by another.
4.2 All applications for membership must be made in writing and must be signed by the candidate and the proposers.
4.3 Election for membership is in the discretion of the Committee.
4.4 An interval of at least five days must elapse between submission of an application for membership and election as a member.
4.5 When a Member has been elected, the Member must pay the Membership Fee as notified to them by the Committee.
5. Membership

5.1 The number of members shall be fixed and controlled by the Committee.
5.2 There are three types of membership:

Full Membership.
Honorary Life Membership.
Visitor Membership.

1. Full Membership

Full membership is given in priority to persons resident within the Strickland, Kettle, and Roger area bounded by Railway Bridge, Kentrigg, Plumgarth Roundabout, Garnett Bridge, and Plantation Bridge. Full membership will also be considered for any person outside the areas stated above.
Full Members shall enjoy all rights associated with membership including attending meetings, holding office, and voting.



2. Honorary Life Membership


The Committee may elect as an honorary life member, any person who, in the Committees opinion have rendered long and valuable service to the Association.
Honorary Life Members shall pay no subscriptions but shall enjoy all the privileges of Full Membership including all rights associated with membership including attending meetings, holding office, and voting.


3. Visitor membership


The Committee may elect members of other Clubs or Associations to use and enjoy the premises and facilities of the Association as Visitor Members for any period not exceeding one month.
The Committee may admit people as Visitor Members on any terms it thinks fit.
A Visitor Member is a member who does not have a season fishing ticket.


5.3 The Committee shall maintain a register of all Members.
6. Membership Fee

The Membership Fee will be notified to all Members by posting it in some conspicuous part of the Association premises (if any) or in any notice, publication or literature issued by the Association not less than 10 days before the said Fee is required to be paid by the Member.


7. Subscription Fee


The Committee may introduce and impose a Subscription Fee from time to time (in addition to the Membership Fee).


7.2 The Subscription Fee will be notified to all Members by posting it in some conspicuous part of the Association premises (if any) or in any notice, publication or literature issued by the Association not less than 10 days before the said Fee is required to be paid by the Member.
8. Resignation

A member wishing to withdraw from the Club must give notice in writing to the Secretary
on or before 31 March in any year, otherwise the subscription for the ensuing year must be
paid.
9. Expulsion

9.1 The Committee may expel any member who offends against the Rules of the Association or whose conduct, in the opinion of the Committee, renders him unfit for membership of the Association.
9.2 Before any such member is expelled, the Secretary must give him fourteen days written notice to attend a meeting of the Committee and must inform him of the complaints made against him.
9.3 No member may be expelled unless he has first had an opportunity to appear before the Committee and answer the complaints made against him and at least two-thirds of the Committee then present vote in favour of his expulsion.
9.4 No member whose membership has been terminated under this rule or who owes money to the Association may be introduced by any other member as a visitor to any part of the Association’s premises.
 
10. Club staff


The Association's staff are under the orders of the Committee only and no member may reprimand a member of staff.
If a member has any cause for complaints, he must bring it before the Committee in writing.


11. Alteration of rules

The Committee may alter the rules, but no alteration takes effect until it has been
confirmed at the next annual general meeting or a special general meeting convened
for the purpose.
12. Byelaws

12.1 The Committee may make byelaws (not inconsistent with these Rules) to regulate the conduct and affairs of the Association.
12.2 The byelaws must be posted in some conspicuous part of the Association premises(if any) or on the fishing licence or similar issued to the Member or in any notice, publication or literature issued by the Association.
 
13. General meetings

13.1 A general meeting of the Association must be held in every year not later than 31 March and must:



receive and, if approved, adopt a statement of the Association’s accounts to the end of the preceding year;
consider and, if approved, sanction any duly made alteration of the rules;
appoint the Officers and other members of the Committee;




13.1.4 appoint an Auditor or Auditors (if applicable);
13.1.5 approve the election of anyone as an Honorary Life Member and
13.1.6 deal with any special matter which the Committee desires to bring before the members and receive suggestions from the members for consideration by the Committee.
13.2 Notice convening the general meeting must be sent to the members or posted in some conspicuous part of the Association’s premises (if any) or in any notice, publication or literature not less than 10 days before the meeting.
14. Special general meetings

14.1 A special general meeting may be convened at any time by the Committee and must be convened within 21 days from receipt of a requisition in writing signed by not less than two members specifying the object of the meeting.
14.2 A special general meeting may be convened:


14.2.1 to consider and, if approved, sanction any duly made alteration of the Rules;



to deal with any special matter which the Committee wishes to place before the members;
to remove any member or members of the Committee from office and to fill any vacancy or vacancies caused by the removal or
to deal with any special matter which the members requiring the meeting wish to place before the Association


14.3 Notice convening a special general meeting must be sent to members or posted in some conspicuous part of the Associations premises or in any notice, publication or literature not less than 10 days before the meeting and must specify the matters to be dealt with.
15. Chairman’s casting vote

At Committee meetings and at general meetings a Chairman must be elected to preside,
and he my have a casting or additional vote in the event of an equality of votes.
16. Quorums


The following numbers are required to form a quorum:




16.1.1 three - at committee meetings (except for the purposes of Rule 9 ‘Expulsion’)



half the total members of the Committee at committee meetings - for the purposes of Rule 9 ‘Expulsion’), and
eight - at general meetings.


16.2 Associate Members and Temporary Members may attend general meetings, but they are not entitled to vote and must not be counted as part of the necessary quorum.
 
 
 
17. Appointment and Retirement of Trustees



Trustees may be appointed from time to time to own land or property (freehold, leasehold, or otherwise) or other assets or similar on behalf of the Association. A Declaration of Trust or similar must be kept in writing to show that such land, property, assets or otherwise is held on trust by the Trustees for the benefit of the Association.
No fewer than two Trustees shall be appointed at any one time. Trustees may be elected at the Annual General Meeting in each year and subject to termination of office by resignation, removal, retirement or otherwise, the Trustees shall remain in office until their successors are elected at the Annual or a Special General Meeting following their election.
The Trustees must be nominated for election by a proposer and a seconder, both of whom shall be Full Members or Honorary Life Members of the Association, and the Secretary shall receive the nominations at least seven days before the Annual General Meeting.
All Trustees shall be honorary.
The Trustees shall not be personally liable for any matters done or carried out or otherwise in their capacity as Trustees on behalf of the Association and the Trustees shall further be indemnified out of the funds of the Association for all liabilities, losses, costs, and expenses incurred in carrying out matters relating to the Association.
 


18.
Conduct of Members


A parent or Full Member must accompany children under the age of 11.
All members must produce their tickets of membership when requested to do so by any other member of the Association, Bailiff, Police Constable, or Riparian Owner.
No member or visitor shall commit wilful damage to any banks or fences or crops adjoining the river and no member is allowed to go on any hay grass from 20th May until the grass is cut.
No member is allowed to take dogs on land boarding the Association water unless there is a well-defined footpath.
Fishing is restricted to the use fly, spinning, and worm only and all other forms of fishing, including fly/maggot are prohibited. Spinning shall commence before 1st June in each year. Prawn/Shrimp fishing is permissible only in specified places and on specified times and dates as notified by the Association in some conspicuous part of the Association premises (if any) or on the fishing licence or similar issued to the Member or in any notice, publication or literature issued by the Association.
No member shall take any fish less than 10 inches in length from the Association water.
No member shall take no more than 4 non-migratory fish from the Association water in any 24-hour period.
Every species of poaching will be suppressed by practical means and offenders shall be prosecuted.
Any member breaking any of the Rules of the Association shall, at the discretion of the Committee, forfeit his membership and be suspended or expelled from the Association in accordance with the Rules of the Association.
All members must comply with the rules and byelaws issued by the National River Authority, or other Governing Authority and attention of all members is particularly drawn to these byelaws set out on the form of Rod Licence.
All members should be in possession of the applicable Rod Licence, in addition to the Membership Permit, before commencing to fish.
No member shall sell any fish caught on the Association water.
Members must ensure that no litter is left in the area where they have fished and must, at all times, observe the Country Code. Discarded line and tackle can injure wildlife and members must take their litter home.


19. Commencement of Rules

These rules shall commence with effect from 21 October 2002
